These Terms and Conditions apply to all bin hire services provided by 1800ALLOUT Pty Ltd ABN 18 665 574 023 ("we", "us", "our") to the customer ("you", "your").
By placing an order or booking a bin, you acknowledge that you have read, understood and agree to these Terms and Conditions.
1. Booking & Hire Period
1.1 A booking is confirmed once we have accepted your order and, where applicable, payment or other agreed payment arrangements have been received.
1.2 The hire period is the period specified on your booking or invoice.
1.3 Bins must be made available for collection on the agreed collection date unless an extension has been approved by us.
1.4 Additional hire charges may apply if a bin is retained beyond the agreed hire period.
2. Delivery & Collection
2.1 You are responsible for ensuring that the delivery and collection location is accessible, safe and suitable for our vehicle and equipment.
2.2 The bin must be positioned in a location that provides direct and unobstructed access for our collection vehicle.
2.3 Our drivers will not enter buildings, premises or restricted areas to collect or deliver bins, including using lifts, loading docks that require entry into the building, or other internal access arrangements, unless specifically agreed with us in advance.
2.4 Bins must be located at a loading dock, driveway or other location where our vehicle has safe and direct access.
2.5 You are responsible for ensuring that gates, vehicles, equipment, construction materials and other obstructions are removed before the scheduled delivery or collection.
2.6 If our vehicle cannot safely access the nominated location, an additional call-out, waiting, redelivery or collection fee may apply.
2.7 We reserve the right to refuse delivery or collection where access is unsafe or unsuitable.
3. Placement of Bins
3.1 You are responsible for obtaining any permission, approval or permit required to place a bin on private property, common property, a loading dock, roadway, footpath or other location.
3.2 You are responsible for ensuring the nominated location is suitable for the weight of the bin and its contents and for any potential damage to the surface.
3.3 We are not responsible for damage to surfaces, driveways, paving, concrete, asphalt, landscaping or other property resulting from the placement or removal of the bin, except to the extent caused by our negligence or as otherwise required by law.
4. Waste Accepted
4.1 Only the waste type specified at the time of booking may be placed in the bin.
4.2 You must accurately disclose the type of waste being placed in the bin.
4.3 Waste must not be mixed with prohibited or restricted materials.
4.4 We reserve the right to refuse collection of a bin containing waste that is prohibited, incorrectly described or otherwise unsuitable for transport or disposal.
4.5 Additional disposal, sorting, handling, transport or other charges may apply where the contents differ from the waste type specified at the time of booking.
5. Prohibited Waste
Unless expressly agreed in writing, the following must not be placed in our bins:
- Asbestos or asbestos-containing materials
- Liquids or liquid waste
- Paints, solvents, fuels or oils
- Gas bottles or compressed gas cylinders
- Chemicals or hazardous substances
- Medical or clinical waste
- Batteries
- Tyres
- Explosives, ammunition or other dangerous materials
- Any waste prohibited by law or by the receiving waste facility
If you are unsure whether a particular material is permitted, you must contact us before placing it in the bin.
6. Loading the Bin
6.1 Waste must remain safely contained within the bin.
6.2 The bin must not be overloaded or filled above the designated fill level.
6.3 Waste must not protrude above the top of the bin or extend beyond its sides.
6.4 You must not compact, compress, burn or otherwise alter the waste in the bin.
6.5 We may refuse to collect a bin that is overloaded, unsafe or likely to spill during transport.
6.6 If additional labour, equipment, transport or disposal costs are incurred because the bin has been overloaded or incorrectly loaded, those costs may be charged to you.
7. Care of the Bin
7.1 The bin remains our property at all times.
7.2 You are responsible for taking reasonable care of the bin while it is in your possession.
7.3 You must not move, modify, paint, damage, sell, hire out, alter or otherwise interfere with the bin without our permission.
7.4 You may be charged for repair or replacement costs resulting from damage, loss, theft, misuse or unauthorised modification of the bin.
8. Delivery & Collection Times
8.1 Delivery and collection dates and times are estimates unless a specific time has been expressly confirmed by us.
8.2 We will make reasonable efforts to meet agreed delivery and collection times but may be delayed by traffic, weather, site access, mechanical issues or other circumstances outside our reasonable control.
8.3 You must ensure the bin is accessible and ready for collection at the agreed time.
8.4 If the bin is not accessible when our driver arrives, an additional collection attempt, waiting time or call-out fee may apply.
9. After-Hours Delivery & Collection
9.1 After-hours delivery and collection may be available by prior arrangement and may incur an additional fee.
9.2 The applicable after-hours fee will be shown at the time of booking or otherwise agreed with you.
9.3 After-hours services are subject to availability and may not be available on all days or at all times.
10. Additional Charges
Additional charges may apply for:
- Additional hire days
- After-hours delivery or collection
- Failed delivery or collection attempts
- Inaccessible sites
- Waiting time
- Redelivery or additional collection trips
- Incorrectly described waste
- Prohibited or contaminated waste
- Overloaded or unsafe bins
- Excess disposal or handling costs
- Damage, loss or theft of the bin
- Council, authority, landfill or other third-party charges incurred as a result of your use of the bin.
Where reasonably practicable, we will notify you of additional charges before they are incurred.
11. Cancellation & Changes
11.1 Cancellation and booking-change fees may apply depending on when the cancellation or change is made.
11.2 If a bin has already been dispatched, delivery or call-out charges may still apply.
11.3 We will advise you of any applicable cancellation or change charges at the time of cancellation or amendment.
12. Payment
12.1 All charges must be paid in accordance with the payment terms shown on your booking, quotation or invoice.
12.2 Where an account has been approved, payment must be made within the agreed account terms.
12.3 We reserve the right to suspend further services where amounts remain unpaid.
13. Customer Responsibility
13.1 You are responsible for the waste placed in the bin and for ensuring that its use complies with all applicable laws, regulations and site requirements.
13.2 You must provide accurate information regarding the waste, delivery location, collection location and any relevant site restrictions.
13.3 You are responsible for notifying us of any hazards, access restrictions or conditions that may affect delivery or collection.
14. Compliance with Laws
All waste must be handled and transported in accordance with applicable laws and regulations.
We may refuse to transport waste where we reasonably believe that doing so would breach applicable legislation, waste facility requirements or our own safety procedures.
15. Liability
To the extent permitted by law, we are not liable for loss or damage arising from circumstances outside our reasonable control.
Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies that cannot lawfully be excluded under applicable Australian Consumer Law or other legislation.
16. Site Access & Safety
We may refuse delivery or collection if our driver reasonably considers the site, access route or placement location to be unsafe.
You must ensure that our drivers can safely access the nominated location without unreasonable risk.
17. Privacy
Personal information provided to us will be handled in accordance with our Privacy Policy and may be used for the purposes of processing bookings, providing services, communicating with you and administering your account.
18. Acceptance
By placing a booking with us, you confirm that:
- The information provided is accurate;
- You have selected the correct waste type;
- You have authority to arrange the bin hire;
- You have obtained any required permissions for the bin's placement;
- The delivery and collection location is accessible and suitable;
- You agree to these Terms and Conditions.
By completing your booking, you acknowledge that you have read and agree to these Terms and Conditions.
